Appeal A Conviction or Sentence in Adelaide

Nicholas Vadasz LLB Barrister & Solicitor has a history of vigorously pursuing appeals in the Court of Criminal Appeal and the High Court of Australia. He has appeared in the SA appeal court as counsel in over 100 appeals against sentence and conviction.

What is an Appeal?

An appeal is the process of disputing a conviction or sentence.  It’s important to know that an appeal is not a retrial or re-hearing. Appeals of conviction or sentence are usually argued on the basis of questions of law. It is vital to be represented by a lawyer who has appeal experience before the judges of the court of criminal appeal.

Appealing Your Conviction

If you’re found guilty after your trial, and you had pleaded not guilty, or you consider your sentence to be too severe, you may be able to appeal the decision. Nicholas has been successful in having convictions overturned and sentences significantly reduced. He also represents clients in cases where the Director of Public Prosecutions appeals on the basis that they consider the sentence inadequate.

Appeal Outcomes

The outcomes that can result from a success appeal include:

  • Reduced sentences
  • A retrial
  • Convictions being quashed and the appellant acquitted
